1. Sexual harassment includes harassment based on sex (including pregnancy, childbirth, or related medical conditions), gender identity, gender expression, or sexual orientation.

2. The employee does NOT verbally have to tell the boss to stop for it to be sexual harassment. People can use body language, excuses, and/or a tone of voice to “say” they are uncomfortable, and the conduct is unwelcome.

3. Sexual harassment can occur at work or outside the workplace.

4. Employees can be held personally liable for harassment.

5. Forcing, pressuring, or threatening someone to do a sexual act is unlawful sexual harassment and may also be a crime.

6. Quid pro quo harassment, (i.e. boss demands sexual favors (going on a date) in exchange for an employment benefit (a promotion), is a form of sexual harassment.

7. Harassment can occur between people of the same gender (i.e. men to men or women to women).

8. Sexual harassment can occur even if the person harassed did not say “no.”

9. If the intent of the action was to be humorous or a joke, it can still be considered sexual harassment.

1. Any person of any gender and age can be a victim of sexual harassment.

2. People can use body language, excuses, and/or a tone of voice to “say” they are uncomfortable.

3. Religious discrimination and harassment is illegal. The right to wear religious dress is protected in California’s workplaces.

4. Employees are NOT required to inform you if they feel sexually harassed by you. They have the right to make a complaint without ever having to notify or confront you.

5. Employees, Supervisors and/or Employers can be personally liable for damages if sued for sexual harassment. Being “personally liable” means you could be personally responsible for, among other things, compensating the victim you harassed from your personal assets such as your bank account, home, or automobile.

6. Quid pro quo harassment, (i.e. boss demands sexual favors (going on a date) in exchange for an employment benefit (a promotion), is a form of sexual harassment.

7. Retaliation is punishing someone for speaking up about sexual harassment or other forms of discrimination or harassment. Retaliation is against the law.

8. Unacceptable Behaviors include: * Required

Bullying and abusive conduct.

Yelling at co-workers.

Making threats (to dismiss, demote, or give a bad review).

Spreading false information or rumors.

Attempts to destroy self-esteem/confidence of others.

Behavior meant to undermine, patronize, humiliate, intimidate, or demean.

9. Unacceptable Behaviors include: * Required

Unnecessary or unwanted touching such as groping, massaging, or pinching, blocking normal movement, or physically interfering with the work of another individual.

Displaying or sharing offensive images such as posters, videos, photos, cartoons, screen savers, emails, drawings, or social media sites that are derogatory or sexual.

Offensive comments about appearance, or other personal or physical characteristics, such as sexually charge comments or comments on someone’s physical disability.
